Indiana Democrats pin legislative gains on abortion debate

Even before Republican legislators this summer made Indiana the first state to pass an abortion ban since the U.S. Supreme Court overturned Roe v. Wade, Democrats started urging angry voters to take their revenge at the ballot box.
Indiana Democrats haven’t let up on that push in the final days of this year’s elections, although a limited number of competitive races on the Nov. 8 ballot for the currently Republican-dominated Legislature leave them with slim chances of being able to do much about abortion access that is also being debated during campaigns across the country.
Indiana Republicans, meanwhile, argue that voters are more worried about other issues such as inflation and crime — concerns widely believed to favor the GOP.
Democratic candidate Joey Mayer said the abortion ban has remained a top issue as she’s talked with voters in a northern Indianapolis suburban district where she’s challenging a four-term Republican House member who voted in favor of the ban when it passed in August.

Family loses Supreme Court bid to extend boy’s life support

Britain’s Supreme Court on Tuesday refused to prevent a hospital withdrawing life support from a 12-year-old boy with catastrophic brain damage, rejecting a bid by his parents to extend his treatment.
The parents of Archie Battersbee had aske Supreme Court justices to block a lower court’s ruling that the Royal London Hospital can turn off the boy’s ventilator and stop other interventions that are keeping him alive.
Archie’s treatment had been due to end at noon on Tuesday, but the hospital said it would await the decision of the Supreme Court.
Justices at the U.K.’s top court said Archie had “no prospect of any meaningful recovery,” and even with continued treatment would die in the next few weeks from organ and heart failure.
The judges agreed with a lower court that continuing treatment “serves only to protract his death.”
Archie was found unconscious at home with a ligature over his head on April 7. His parents believe he may have been taking part in an online challenge that went wrong.
Doctors believe Archie is brain-stem dead and say continued life-support treatment is not in his best interests. Several British courts have agreed.
The family appealed to the U.N. Committee on the Rights of Persons with Disabilities, and wanted the withdrawal of treatment put on hold while the committee examines the case.

Myanmar seeks to have Rohingya case thrown out of UN court

Lawyers for Myanmar’s military rulers on Monday sought to have a case at the United Nations’ top court that accuses the Southeast Asian nation of genocide against the Rohingya ethnic minority dismissed for lack of jurisdiction.
Public hearings at the International Court of Justice went ahead amid questions about who should represent Myanmar in the aftermath of the military take-over of the country last year.
A shadow administration known as the National Unity Government made up of representatives including elected lawmakers who were prevented from taking their seats by the military takeover had argued that it should be representing Myanmar in court.
But, instead, it was the administration installed by the military. The legal team was led by Ko Ko Hlaing, the minister for international cooperation. He replaced pro-democracy icon Aung San Suu Kyi, who led the country’s legal team at earlier hearings in the case in 2019. She now is in prison after being convicted on what her supporters call trumped-up charges.
As the hearing started, the court’s president, U.S. Judge Joan Donoghue, noted “that the parties to a contentious case before the court are states, not particular governments.”
A Myanmar rights group questioned the court’s decision to allow the military regime to represent Myanmar, which was formerly known as Burma.

Order: Mississippi judges have discretion for COVID safety

Mississippi judges have the power to delay trials, limit the number of spectators in courtrooms or take other steps to try to slow the spread of COVID-19, the leader of the state Supreme Court says in an emergency order.
Chief Justice Michael Randolph issued the order Thursday in response to the rapid spread of illness caused by highly contagious delta variant of the virus.
Mississippi has one of the lowest COVID-19 vaccination rates in the nation, and the state health officer, Dr. Thomas Dobbs, said Friday that 97% of new cases of COVID-19 in Mississippi are among people who are unvaccinated.
Randolph’s order said judges may postpone jury trials that are scheduled through Sept. 10. In addition to limiting the number of spectators in courtrooms, judges may require people to wear masks and maintain distance between each other. The order encouraged courts to use teleconferencing and videoconferencing, when possible.
Plea hearings in felony cases must still take place in person, but defendants and others in the courtrooms should wear masks and maintain social distancing.
“Any in-person proceedings shall be limited to attorneys, parties, witnesses, security officers, members of the press and other necessary persons, as determined by the trial judge,” Randolph wrote.
