Arkansas candidate's political ties targeted in court race

The race for a seat on the Arkansas Supreme Court is technically nonpartisan, but the close ties of one of the two main candidates to the state Republican Party — she's married to its leader — highlight just how partisan such campaigns have become, with outside conservative groups outspending the candidates themselves.
Barbara Webb, chief administrative law judge for the Arkansas Workers Compensation Commission and the wife of the state Republican Party chairman, is running against Pulaski County Circuit Judge Morgan “Chip” Welch in the March 3 election.
Although both candidates have been promising to be independent voices if elected to the court, Welch has been making noise about Webb's appeals to Republicans and speeches to GOP gatherings around the state. She's had public support from top Republican leaders, including Sen. Tom Cotton and former White House Press Secretary Sarah Sanders, and one of Webb's campaign mailings features a photo of GOP Gov. Asa Hutchinson.
“It hadn't escaped my notice that party politics is the family business,” Welch said recently. “It is some concern to me. I noticed that she's pretty much talking to an echo chamber of one political party.”
Webb and Welch are running for the seat being vacated by retiring Justice Jo Hart, and whoever wins will be elected to an eight year term. The court has angered conservatives in recent years with rulings blocking part of the state's plan to execute eight inmates in quick succession in 2017 and disqualifying a GOP-backed 2018 ballot measure that sought to cap the amount of damages that could be awarded in lawsuits. |

Justices return for season of big decisions, amid campaign

For a Supreme Court that says it has an allergy to politics, the next few months might require a lot of tissues.
The court is poised to issue campaign-season decisions in the full bloom of spring in cases dealing with President Donald Trump’s tax and other financial records, abortion, LGBT rights, immigration, guns, church-state relations and the environment.
The bumper crop of political hot potatoes on the court’s agenda will test Chief Justice John Roberts’ insistence that the public should not view the court as just another political institution.
“It’s interesting that all of this is coming together in an election year. The chief justice has made it clear that people should view the court as a nonpolitical branch of government and people tend to have the opposite view when they see these big cases,” said Sarah Harrington, who has argued 21 cases in front of the high court.
The justices are gathering on Friday for the first time in nearly a month to put the finishing touches on opinions in cases that were argued in the fall and decide what new cases to take on. Most prominent among the possibilities is the latest dispute over the Obama-era health care overhaul. |

Lesotho's PM fails to show in court to face murder charge

Lesotho’s prime minister failed to show up in court on Friday to be charged with murder in the killing of his estranged wife, and police said he might have gone to neighboring South Africa for an undisclosed ailment.
Prime Minister Thomas Thabane's current wife, Maesaiah, also has been charged with murder in the 2017 death of Lipolelo Thabane. She had briefly fled the kingdom for South Africa, avoiding a police summons.
Deputy Commissioner of Police Paseka Mokete, who led the investigation, said he had heard rumors that the 80-year-old prime minister had gone to South Africa for a medical check-up.
“I have spoken to Thabane’s lawyer and he told me he is not aware of the prime minister’s whereabouts,” Mokete said. “We are now waiting for him to return so that he can be charged.”
It would be premature to seek an arrest warrant for the prime minister as police did when Maesaiah Thabane refused to honor a police summons last month, Mokete said.
On Thursday, Mokete confirmed to The Associated Press that the prime minister would appear at Maseru Magistrates Court to face a murder charge and an attempted murder charge in connection with a shooting of a friend of Lipolelo Thabane.
Thomas Thabane is the first sitting prime minister in Lesotho to be charged with any crime. He has announced he would step down by the end of July, if not sooner, amid pressure from the ruling party, which says he is no longer fit to rule. |

Court: Life support decision didn't need judge's approval

A judge was wrong to conclude that court approval is needed for a guardian’s request to remove a woman from life support, the New Hampshire Supreme Court said in an opinion released Wednesday.
The 69-year-old woman, identified as “L.N.,” was admitted to Concord Hospital in 2018 after suffering a stroke. Doctors said damage to her brain was irreversible.
L.N.’s court-appointed guardian said while L.N. never specifically stated her end-of-life preferences, the two had discussed the subject in general. The guardian’s sense was that L.N. would want to be allowed to have a natural death.
A circuit court judge ruled the guardian would need prior court approval before deciding to end L.N.’s life support. The judge also said a question remained as to whether L.N. would regain an ability to communicate. The guardian appealed.
State law doesn’t specifically mention life-sustaining treatment requiring a judge’s prior approval. The supreme court concluded the guardian’s general authority includes the decision to end life support, in appropriate circumstances. |

Walker appointee, judge, prof face off in high court primary

Wisconsin voters will choose between a Republican appointee, a Madison judge and a law professor as they winnow down the candidates for a state Supreme Court seat in a primary Tuesday.
Conservative Justice Dan Kelly will face off against liberal-leaning Jill Karofsky and Ed Fallone. The top two vote-getters will advance to the April 7 general election with a 10-year term on the high court at stake.
The race can’t change the court’s ideological leaning since conservative-leaning justices currently have a 5-2 edge. But a Kelly defeat would cut their margin to 4-3 and give liberals a shot at a majority in 2023.
Then-Gov. Scott Walker, a Republican, appointed Kelly to the Supreme Court in 2016 to replace the retiring David Prosser. An attorney by trade, he represented Republican lawmakers in a federal trial over whether they illegally gerrymandered Wisconsin’s legislative district boundaries in 2011. He’s also a member of The Federalist Society, a conservative organization that advocates for a strict interpretation of the U.S. Constitution.
Karofsky is a wiry marathon runner who has completed two Iron Man competitions. She also won the state doubles tennis championship in 1982 for Middleton High School.
She has served as an assistant prosecutor in the Dane County district attorney’s office, general counsel for the National Conference of Bar Examiners and executive director of the state Department of Justice’s Office of Crime Victim Services. She won election as a Dane County circuit judge in 2017.
